Warranty and Complaints

Legal information for the B2B online shop www.microtronik.de. If translations differ, the German version prevails unless mandatory law provides otherwise.

1 Scope

These rules apply to sales by MD AUTO to entrepreneurs and business customers. The Terms and Conditions, individual agreements and applicable law also apply.

2 Statutory rights and guarantees

Statutory defect rights concern defects existing when risk passed. A voluntary seller or manufacturer guarantee applies only when expressly stated for the product and is governed by the guarantor’s terms. It does not restrict mandatory defect rights.

3 Agreed condition

The individual agreement, order confirmation, product description, confirmed specifications and agreed use determine the required condition. The buyer checks compatibility unless the seller confirmed it in writing.

4 Inspection and notice

The buyer must promptly inspect completeness, conformity, transit damage and visible defects. Where German commercial law applies, section 377 HGB applies. Hidden defects must be reported promptly after discovery.

5 Complaint

Complaints may be sent to info@microtronik.de or through the return form. They should include company and contact name, order or invoice number, product and serial number, delivery date, defect description and available photographs, videos, measurements or error messages.

6 Return

Goods should be returned only after receiving return instructions. They must be complete and securely packed. Missing original packaging does not remove statutory rights, but the buyer remains responsible for safe transport packaging.

7 Examination and remedy

The seller must first have a reasonable opportunity to examine and remedy a justified defect, including by repair or replacement. A selected remedy may be refused where impossible or disproportionately costly to the extent permitted by law. Further rights are subject to applicable legal conditions.

8 Exclusions

Claims do not apply to the extent the condition was caused by normal wear, improper installation or use, unsuitable power, reversed polarity, overvoltage, electrostatic discharge, moisture, external impact, unauthorised repair or modification, incorrect coding or compatibility that was not promised.

9 Data on devices

Before return, the buyer should back up and remove confidential or personal data and disable accounts where possible. Data may be lost during examination, repair or replacement.

10 No general return right

B2B purchases do not carry a statutory consumer cancellation right. Non-defective goods may be returned only by prior express agreement.

11 Limitation and liability

Limitation periods and liability follow the contract, incorporated Terms and applicable law. Mandatory claims, including fraud, intent, personal injury, an express guarantee and mandatory product liability, remain unaffected.
